Regulations of the online store www.galakor.pl and RODO privacy policy

INTRODUCTION

1. The owner of the online store www.galakor.pl is the companyGrafag Sp. J., based in Opoczno, Janas Street 13, NIP: 7681560375, REGON: 590712404, KRS: 0000228005.
2.shipping is territorially limited to the territory of Poland only.
3.the prices displayed on the store are in Polish zloty (PLN) and include the VAT tax. Grafag Sp. J. reserves the right to change prices without prior notice to the Ordering Party, provided that price changes do not apply to orders in progress.
 

ORDERS

1.the basic condition for the realization of purchases made is the correct placement of the order, selection of the form of payment and transport.
2.placing an order is at the same time a declaration that you have read the terms and conditions and fully accept them.
3.the company Grafag Sp. J. will process submitted orders no later than 24 working hours from the moment of submission by the Purchaser, but this deadline may be extended in the case of a large number of orders.
4. Via galakor.pl Grafag Sp.J. accepts orders around the clock on all days of the year. Orders placed on Saturday, Sundays and holidays will be processed in the order in which they are placed on the first working day following the day on which the order was placed.
5.when payment is made by bank transfer, the goods are sent to the Orderer when the account of Grafag Sp J. appropriate funds will be received.
6. If the order does not require additional clarification Grafag. Sp.J. proceeds with its implementation without contacting the customer.
7.the conclusion of the contract of sale occurs when the order is forwarded for processing.
8.the order will not be realized in case of giving incorrect or incomplete data by the ordering party and in case the transfer is not paid in due amount within the indicated time or the parcel is not collected from the courier.
9.the order will be processed provided the goods are in stock. In case of unavailability of the goods covered by the order, the ordering party is informed about this fact and decides on the method of its realization (partial realization, extension of the waiting time, cancellation of the order).

TERMS OF DELIVERY OF GOODS

1.the purchaser can choose the following forms of delivery:
- courier consignment ( transport of Grafag company or DPD carrier )
- cash on delivery ( it is a delivery by Grafag company or DPD carrier)

- courier
2.lead times given in the auction description are approximate and may be extended in certain situations beyond the control of Grafag Company.
3.goods are shipped by a shipping company within 5-10 business days after the payment is credited to our account. It is realized only after prior arrangement by phone and after 100% payment is received on the account of Grafag Sp. J.
4. Delivery by Grafag transport is a guarantee that the ordered goods are in accordance with the order, so the lead time depends on the place of delivery. Delivery time is 7-21 business days depending on the region of Poland.
 

PAYMENTS

The following forms of payment apply:

a) prepayment- payment should be made to the account of Grafag Sp. J. given below.

b) cash on delivery- payment is made upon receipt of goods delivered by the driver. Cash-on-delivery payment is possible only with Grafag's transportation service.
 

VAT INVOICES

Each transaction ends with a receipt or, on request, a Vat invoice with a 23% rate.
 

ADVERTISEMENTS

1. All products sold by Grafag are brand new products. Products have manufacturer's warranty , valid in Poland.
2. Complaints are accepted only in writing, sent by Polish mail. Grafag does not accept any parcels sent back cash on delivery.
3. In case of mechanical damage during collection of the parcel from the courier, the damage protocol should be written in the presence of the carrier.
4. The claimed goods must be accompanied by a proof of purchase. The complaint should include a detailed description of the defect in the goods and the date on which the defect arose. In the case of complaints handled remotely, it is necessary to take photos showing the damage.
5. Complaints are processed no later than 14 days from the date of notification.
6. In the case of a justified complaint, the goods will be repaired or replaced with another, and if this is no longer possible (for example, due to out-of-stock), Grafag will refund the buyer the equivalent of the product price (within 14 days) or offer him other goods available in the store to choose from.

1. In accordance with the Law on Consumer Rights of May 30, 2014. (OJ.U. 2014 r. pos. 827 as amended.) The purchaser may resign from the goods purchased remotely without giving any reason within 14 days from the date of receipt of the shipment by making a statement to that effect in writing or by e-mail.

2. If you decide to withdraw from the contract, the customer should send back the goods duly packed within 14 days of notification to the seller that he withdraws from the contract of purchase at a distance - the goods are sent back at your own expense. 
3.Returns are allowed only for unused goods (not bearing any signs of use), not damaged and originally packaged, if the goods came in a package. 
NOTE! Any goods made to order for the customer such as sale goods or second-hand goods are not returnable !. 

4. If all ww. conditions for the return of the goods will be met, a refund of the price of the returned goods will be made within 14 days (from the date of receipt of the goods by Grafag) by making a wire transfer by Grafag Sp. J. to the account indicated by the Purchaser. .

DATA PROTECTION RODO - Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016. on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC

1. Filling in the data in the order form is tantamount to consenting to the processing of the Orderer's personal data by Grafag Sp. J.

The Ordering Party's personal data will be processed solely for the purpose of processing the order placed, including invoicing and financial reporting. This data is confidential and will not be disclosed to third parties except to courier companies with which Grafag cooperates.
2.buyer's personal data protected in accordance with the Personal Data Act shall not be transferred, resold or lent to other persons or institutions are necessary for the fulfillment of the contract of purchase - sale of goods and services.
3.only Grafag employees involved in online sales have access to personal information.
4. Each Buyer who has completed the order form has the opportunity to access the data concerning him in order to verify, modify or delete it.

RODO PRIVACY POLICY
Provision of personal data, as well as consent to their processing, is completely voluntary. Any personal data you provide to us is processed only to the extent and for the purpose for which you have given your consent. However, in case you decide not to provide us with the data necessary for the execution of the order and do not consent to its processing, unfortunately we will not be able to process your order.

At any time you have the right to update or completely delete your personal data. You can do it yourself or with our help by contacting us.

Grafag SP.J has applied technical and organizational measures to ensure the protection of the processed data in accordance with the requirements set out in the applicable legislation on the protection of personal data. In particular, the following were taken into account: the Regulation of the Minister of Internal Affairs and Administration of April 29, 2004. on documentation of personal data processing and technical and organizational conditions that should be met by devices and IT systems used for personal data processing (Dz. U. No. 100, pos. 1024); guidelines of the Inspector General for Personal Data Protection; Regulation 2016/679 of the European Parliament and of the Council (EU) of April 27, 2016. on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC.
Some of the most important elements of the data protection system we use include:

1.SSL certificate, which guarantees that communication between your computer and galakor.pl is encrypted through a 256 bit key.
2.We collect and process only the necessary personal data for the shortest possible time.
3.Access to your personal data, only authorized persons in the field of data protection have access to it.
4.Galakor IT System.pl and procedures inside the company meet all standards of personal data protection.

⦁ Personal data, purpose and duration of storage
1. Registration
When registering, please provide the information necessary to create an account on the galakor website.en
A registered customer, after logging in, also has the ability to verify the status of the order placed and the history of purchases made. A registered and logged-in customer can at any time independently correct, supplement or completely delete data from the galakor website.en
When registering, please:
1. name and surname - data needed to issue a sales document
2. address (street, house number and/or house and premises number, postal code and city) - data for later addressing of the shipment
3. e-mail - e-mail address necessary for login and communication related to the use of the galakor website.en
4. telephone number - necessary if you choose certain delivery methods (required by delivery companies)
Data is stored for a period of 5 years after the last login.

⦁ Placing an order

When placing an order, we ask you to provide us with the data necessary for processing, which, in the case of registered and logged-in customers, is partly taken automatically from the data you provided during the registration process.
When placing an order, please specify:
1. name and surname - data needed to issue a sales document
2. address (street, house number and/or house and premises number, postal code and city) - data for later addressing of the shipment
3. e-mail - e-mail address necessary for login and communication related to the use of the galakor website.en
4. telephone number - necessary if you choose certain delivery methods (required by delivery companies)

If, when placing an order, the customer chooses delivery to an address other than the one specified when registering or placing the order, please additionally specify:
1. name and surname - data needed to issue a sales document
2. address (street, house number and/or house and premises number, postal code and city) - data for later addressing of the shipment
3. e-mail - e-mail address necessary for login and communication related to the use of the galakor website.en
4. telephone number - necessary if you choose certain delivery methods (required by delivery companies)

If, when placing an order, the customer chooses to issue a sales document for other data than that indicated when registering or placing an order, please additionally provide:
1. name and surname - data needed to issue a sales document
2. address (street, house number and/or house and premises number, postal code and city) - data for later addressing of the shipment
3. e-mail - e-mail address necessary for login and communication related to the use of the galakor website.en
4. telephone number - necessary if you choose certain delivery methods (required by delivery companies)

The data you provide when placing an order is processed by the galakor website.pl and the following entities to the extent stated below:
1. name, address, telephone, e-mail indicated as delivery address are forwarded to shipping companies in the form of a shipping label/letter which is at the same time an order for delivery of the shipment depending on the type of shipment selected are forwarded :

Data are stored for a period of 5 years from the end of the calendar year following the year in which the sales document was issued, in accordance with the relevant regulations governing the duration of storage of accounting documents.

⦁ Correspondence
In the event that personal data is provided to us that is not necessary for the performance of the contract or a legal obligation, e.g. in correspondence with us, withdrawal, warranty or guarantee forms, such data will be deleted immediately and will not be processed.

Please do not provide us with information and personal data that we do not ask for and are not related to the order placed.

Your personal information, which is collected automatically when you access the galakor website.pl constitute computer data, in particular text files, which are stored on the final device of the customer galakor.en

As part of the galactor.pl two main types of cookies are used: "session cookies" and "permanent cookies" (persistent cookies). "Session" cookies are temporary files that are stored on the customer's terminal device until the customer logs out, leaves the website or shuts down the software (web browser). "Permanent" cookies are stored on the Client's terminal device for the time specified in the parameters of the cookies or until they are deleted by the Client.

1. cookies that enable you to use the services available through galakor.pl such as authentication cookies used for services that require authentication on the site.

The information system used by the galakor website.pl automatically collects in logs data related to the device you use to connect to galakor.en. This data is collected for statistical purposes only and relates to such things as device type, operating system, browser type, screen resolution, color depth, IP, ISP, or entry address to galakor.pl and are used only in the process of optimizing galakor.pl in order to ensure the greatest possible comfort of use.
These data serve only as material for statistical analysis and mechanisms for correcting system errors.
Galakor.pl uses the servers of IAI Joint Stock Company 30 Piastów Avenue PL-71-064 Szczecin
This company does not have direct access to personal data and does not process it in any way.
Data is processed for 24 months after last activity.

⦁ Galakor.en(cookies)
Galakor.pl uses cookies to:
1.remembering the contents of your shopping cart (the session lasts 30 days from the last activity, after which the cookies are deleted)
2.remembering logging in (the session lasts 30 minutes from the last activity, after which cookies are deleted)
3.creation of statistics and viewing reports of galakor operation.en

⦁ Transfer of your personal data
In specific situations where applicable law directs the Personal Data Controller to transfer the collected data to state authorities, galakor.pl will make such data available.

With the exception of these situations, your personal data, to the extent permitted by law on the basis of separate entrustment agreements, transferred to certain entities exclusively and in connection with the need to fulfill a contractual or legal obligation of the Personal Data Administrator. The categories of entities to which the data may be transferred include: advertising agencies, banks, accounting and bookkeeping offices, IT service providers, courier companies, logistics companies, payment institutions, and carriers.

In the event of such transfer, the Personal Data Administrator shall enter into appropriate entrustment agreements with such entities, guaranteeing the highest standard of protection and preservation of confidentiality and security of personal data, as well as their use only for the purpose of fulfilling the contractual or legal obligation of the Personal Data Administrator.

In accordance with the applicable regulations in relation to your personal data, you have the right to:

4. rectification or deletion of personal data
5. portability of personal data

7. lodge a complaint to the supervisory authority - the President of the Office for Personal Data Protection.
These rights are non-transferable and cannot be restricted.

1.The content of the Online Store does not constitute a commercial offer within the meaning of the Civil Code art. 543. The store reserves the right to possible errors.
2.the company Grafag Sp. J. reserves the right to:
- changes in prices and quantities of goods on offer in the online store during the day
- withdrawal of individual products from the offer
- introduction of new goods to the offer
- carry out and cancel all kinds of promotional actions and sales.
3. In matters not regulated by the above Regulations, the relevant provisions of the Civil Code shall apply.

5.in accordance with Art. 384. § 1. Civil Code, the provisions of these Regulations are binding on the Seller and the Buyer. By placing an order, the customer accepts the above regulations.
